# MediTest Terms of Use

These Terms of Use ("Terms") govern your access to and use of MediTest Prep, also shown in the app as MediTest ("MediTest", "we", "us", or "our"), including the iOS application, content, AI-assisted explanations, quizzes, progress features, and related services.


## 1. Acceptance of These Terms

By downloading, accessing, or using MediTest, you agree to these Terms and to the MediTest Privacy Policy. If you do not agree, do not use the app.

If you downloaded MediTest from the Apple App Store, Apple's applicable App Store terms and the Apple Standard End User License Agreement may also apply. These Terms supplement those terms and do not limit rights you may have under Apple's terms or applicable law.

## 2. Educational Use Only

MediTest is an educational study tool for medical exam preparation. It is not a medical device, clinical decision support tool, official exam source, healthcare provider, medical consultation, diagnosis, treatment, or patient-care service.

You must not use MediTest for medical emergencies, patient care, diagnosis, treatment decisions, or as a substitute for qualified medical professionals, official exam materials, or authoritative educational sources.

## 3. Content Accuracy

MediTest may include questions, answer options, explanations, topic progress, weak-topic analysis, and AI-generated responses. This content may be incomplete, inaccurate, outdated, or unsuitable for your specific purpose.

You are responsible for independently verifying important information against official exam materials, textbooks, clinical guidelines, and other authoritative sources. We do not guarantee that using MediTest will improve scores, satisfy exam requirements, or produce any specific academic or professional outcome.

## 4. AI-Assisted Features

AI-assisted explanations and chat responses are generated automatically and may contain errors. You must review AI output critically and must not rely on it as medical advice, legal advice, professional advice, or an authoritative statement of exam requirements.

Do not submit patient information, personal health information, confidential information, third-party personal data, or other sensitive information into AI chat features.

## 5. Accounts, Device Authentication, and Security

MediTest may use device-based authentication to create or refresh your app session. You are responsible for maintaining control of your device and for any activity that occurs through your app session.

You agree not to bypass, interfere with, reverse engineer, scrape, overload, or attempt to gain unauthorized access to MediTest, its backend services, authentication systems, certificate pinning, security features, or related infrastructure.

## 6. Acceptable Use

You agree that you will not:

- use MediTest for unlawful, harmful, fraudulent, abusive, or unauthorized purposes;
- copy, redistribute, sell, sublicense, or commercially exploit MediTest content except as allowed by these Terms;
- submit malicious code, automated requests, spam, or abusive traffic;
- interfere with app operation, servers, networks, security, or other users;
- attempt to extract question banks, answers, explanations, AI prompts, models, source code, or non-public data;
- infringe intellectual property, privacy, publicity, or other rights;
- use MediTest in a way that violates applicable laws, exam rules, professional obligations, or third-party terms.

## 7. Intellectual Property

MediTest, including its app design, software, content, question organization, explanations, logos, trademarks, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use MediTest for lawful educational purposes.

No rights are granted except those expressly stated in these Terms.

## 8. Your Messages and Inputs

If you submit messages, answers, prompts, feedback, or other content through MediTest, you grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce, and use that content as needed to provide, secure, maintain, and improve MediTest.

You represent that you have the rights needed to submit any content you provide and that your content does not violate law, third-party rights, confidentiality obligations, exam rules, or these Terms.

## 9. Purchases and Paid Access

MediTest may offer paid features, subscriptions, or premium access, including MediTest Plus. Pricing, billing period, renewal, cancellation, refund, and purchase-management details are shown at the point of purchase or by the App Store.

If purchases are made through Apple's App Store, payment is charged by Apple, and subscription management, cancellations, and refunds are handled through your Apple ID and Apple's policies. We do not control Apple's billing systems.

Unless required by law or Apple's policies, fees are non-refundable once paid.

## 10. Third-Party Services

MediTest may depend on third-party services such as hosting, infrastructure, AI-processing, or App Store payment services. Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.

## 11. Updates and Availability

We may modify, suspend, discontinue, limit, or update MediTest or any feature at any time. We may also change question content, explanations, AI behavior, pricing, availability, or backend functionality.

MediTest may be unavailable due to maintenance, outages, network issues, security events, or third-party service failures. We do not guarantee uninterrupted or error-free operation.

## 12. Termination

We may suspend or terminate access to MediTest if we believe you violated these Terms, created risk, caused harm, violated law, abused the service, or interfered with app operation.

You may stop using MediTest at any time. Deleting the app removes local app data managed by iOS, but it may not automatically delete server-side records.

## 13. Disclaimers

To the maximum extent permitted by law, MediTest is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that MediTest content is correct, complete, current, suitable for an exam, suitable for medical practice, or free from errors.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

## 14. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, exam results, academic outcomes, professional outcomes, or business opportunities arising from or related to MediTest.

To the maximum extent permitted by law, our total liability for any claim related to MediTest will not exceed the greater of the amount you paid to use MediTest during the three months before the claim arose or USD 50.

Some jurisdictions do not allow certain liability limits, so parts of this section may not apply to you.

## 15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Maxim Novikov from claims, damages, losses, liabilities, costs, and expenses arising from your use of MediTest, your content, your violation of these Terms, or your violation of law or third-party rights.

## 16. Governing Law and Disputes

These Terms are governed by applicable laws, excluding conflict-of-law rules, unless applicable consumer protection laws require otherwise.

Any disputes related to these Terms will be handled by courts or authorities with competent jurisdiction under applicable law.

## 17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required by law, such as by updating the effective date, posting the updated Terms, or providing an in-app notice. Your continued use of MediTest after changes become effective means you accept the updated Terms.
